New developments in the composition of the Constitutional Court

Abstract

The constitutional amendment of 2020 witnessed the establishment of judicial
control over the constitutionality of laws in Algeria through the Constitutional Court
instead of the political control exercised by the Constitutional Council, through the
statement of the controls sponsored by the constitutional founder in their structure and the
most important conditions by which they were supported. In particular, those relating to
how to gain membership and ensure its independence, which are reflected in the
statement of the appointment and election of 12 members, with new and strict requirements of competence and professional experience in the field of law, to enable
them to exercise their duties professionally, impartially and neutrally without being
subjected to indirect pressure.
