أسس الحوكمة في المصارف الإسلامية وتحديات تطبيقها -تجارب دولية-

Abstract

تهدف هذه الورقة البحثية إلى دراسة واقع تطبيق مبادئ الحوكمة الشرعية الصادرة عن المؤسسات الدولية الإسلامية، وأهميتها في ممارسة الرقابة الشرعية وزيادة قدرتها التنافسية التي تؤدي إلى الرفع من كفاءتها أمام المصارف التقليدية. وتوصلنا إلى مجموعة من النتائج أهمها أن المصارف الإسلامية العاملة في ماليزيا وباكستان والسودان تطبق قواعد ومبادئ الحوكمة الشرعية وكذلك المصرف الإسلامي الأردني، وهذا ما انعكس على أدائها وتطوير خدماتها المقدمة، كما نوصي الجهات الإشرافية بالاهتمام بإصدار تعليمات واضحة، لازمة التطبيق من قبل المصارف بخصوص الحوكمة. This research paper has been intended to study application of sharia governance principles issued by international Islamic institions and their importance in practicing sharia supervision. In addition to their competitiveness increase that leads to upgrading its efficieney comparing to traditional banks. We have figured out some realization; the mast important of which are Malaysian, Pakistani, and Sudanese Islamic banks applying sharia governance rules and principles, as well as the Jordanian Islamic bank and this is reflected in their performance and development of their provided serviees. As we recommend from the supervisory authorities to pay attention to issuing clear instruction, that are necessary for implementation by Islamic banks.
