Abstract

The defense of the unconstitutionality of laws is a type of judicial oversight, and thus this article addresses the issue of the defense of the unconstitutionality of laws. This study aims to clarify the provisions regulating the defense of unconstitutionality and the
limits of its implementation, as this mechanism was stipulated under Article 195 of the Algerian constitutional amendment in 2020.
 The mechanism for defending unconstitutionality enabled the litigant to defend his
rights and freedoms guaranteed by the constitution, as litigants had the right to raise the
defense of unconstitutionality on the occasion of a court case being considered, and
Organic Law 18-16 clarified the conditions and modalities of its application.
