Abstract

 The interests of both partners and others within the commercial company are numerous, and in many cases they diverge and overlap, resulting in the emergence of disputes and disagreements that may mortgage the normal functioning of these
companies, which affects them negatively and may reach a complete halt to their activities. The unusualness of these companies affects the interests of those intervening
and others and the general economic interest, the Algerian legislator gave the judge the power to intervene, whether as an urgent judge, or as a matter judge to ensure the normal
functioning of these companies, and this is under the misleading of the social interest of the commercial company, which is one of the most important components of the
commercial company Especially the financial companies, which came in response to the
participatory democracy movement, ie the democratization of commercial companies.
